Customer terms
The agreement between LuxArte Ltd and the businesses that use MOTVIVO.
Version 1.1 · Last updated: 9 October 2026
These customer terms (the “Terms”) are the agreement between LuxArte Ltd, Michail Koutsofta, 17, Anarita 8502, Cyprus, company registration no. HE 465325, VAT ID 60097364M (“LuxArte”, “we”, “us”), which provides MOTVIVO, and the club, studio, trainer or other business that uses MOTVIVO (the “Club”, “you”). They apply when you accept them, for example when you sign up or when an administrator accepts them in the staff app, and for as long as the Club uses MOTVIVO. If the Club has a separate written agreement with LuxArte, that agreement takes precedence where it differs.
1. Who can use MOTVIVO
- MOTVIVO is for businesses only. By accepting these Terms you confirm that the Club acts for business purposes, not as a consumer, and that the person accepting them is at least 18 and authorised to bind the Club.
- The Club is responsible for the accounts of its staff, for keeping passwords safe and for everything done through its accounts. The Club tells us without delay about any unauthorised use.
- The details the Club gives us (business name, contact details, legal and tax details) must be accurate and kept up to date.
2. The service
MOTVIVO is software for running a fitness business: a staff app, a booking app for the Club’s members, and related features, as described at motvivo.com. What is included depends on the Club’s plan. We develop MOTVIVO continuously and may add, change or remove features; we will not remove a core feature of a paid plan during a paid period without offering a reasonable alternative or a pro-rata refund.
We aim for MOTVIVO to be available at all times, but we do not guarantee uninterrupted availability. We announce planned maintenance in advance where reasonably possible. Support is provided by email ([email protected]) on business days.
3. Plans, trial and fees
- Plans. The plans, their limits and prices are shown at motvivo.com/pricing. The Free plan costs nothing and has no time limit.
- Trial. A new Club gets the Studio plan free for 30 days. When the trial ends the Club continues on the Free plan automatically unless it chooses a paid plan; it is never charged without choosing one.
- Paid plans are billed monthly or yearly in advance. Prices are in euros and exclude VAT, which is added where it applies (for clubs in another EU country with a valid VAT number, the reverse charge applies). Unless the Club cancels before the end of a billing period, the plan renews for the same period. The Club can cancel at any time in MOTVIVO’s Settings or by email to [email protected]; the plan then stays active until the end of the period already paid for.
- Limits. If the Club goes over its plan’s limits we tell it and may pause new sign-ups or features until it upgrades; existing members and bookings keep working.
- Price changes are announced at least 30 days in advance and apply from the next billing period. If the Club does not agree, it can cancel before then.
- Late payment. If a paid plan isn’t paid within 7 days of its due date, the Club moves to the Free plan’s limits until it is paid. No data is deleted because of late payment.
4. Online payments from members
- If the Club takes payments online through MOTVIVO, it does so through its own account with Stripe, under Stripe’s terms (including the Stripe Connected Account Agreement). Payments go directly to the Club’s Stripe account; LuxArte does not receive or hold the Club’s funds.
- For each online payment, LuxArte charges the platform fee for the Club’s plan shown at motvivo.com/pricing (currently 2% on Free, 1% on Studio and 0.5% on Club). It is deducted automatically by Stripe. Stripe’s own fees are separate and charged by Stripe. There is no fee for bookings themselves.
- The Club is the seller of everything it sells to its members. It is responsible for its prices, its terms and cancellation rules, refunds, the information it must give consumers, and its taxes. MOTVIVO helps with features such as receipts and checkout information, but the Club remains responsible for their content.
5. Data
- The Club owns its data and is the controller of the personal data of its members and staff. LuxArte processes that data on the Club’s behalf under the data processing agreement, which forms part of these Terms.
- The Club makes sure it has a lawful basis for the data it puts into MOTVIVO and gives its members the information the law requires (for example its own privacy policy).
- LuxArte may use aggregated, anonymous statistics that do not identify the Club or any person to run and improve MOTVIVO.
- The Club can export its data at any time from the staff app.
6. Acceptable use
The Club may not use MOTVIVO to break the law or the rights of others; to send spam or messages people did not agree to receive; to impersonate another business or person; to upload malicious code; to try to access other clubs’ data or our systems without permission; or to overload, copy or resell the service. We may remove content or suspend access where this is necessary to stop a serious breach, to protect members or other clubs, or because the law requires it. Where possible we warn the Club first and give it a chance to fix the problem.
7. Intellectual property
MOTVIVO, its software, design and brand belong to LuxArte or its licensors. The Club gets a non-exclusive, non-transferable right to use MOTVIVO for its own business while these Terms apply. The Club keeps all rights in its own content (such as its name, logo, texts and photos) and allows us to use it only to provide MOTVIVO. If the Club sends us suggestions, we may use them freely.
8. Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where the law does not allow liability to be limited.
- Otherwise, each party’s total liability under these Terms in any 12 months is limited to the fees the Club paid LuxArte in those 12 months (plan fees and platform fees), or €500 if that is more. Neither party is liable for indirect or consequential loss, such as lost profit or lost business.
- The Club is responsible for the classes and services it provides to its members and for its relationship with them. LuxArte is not a party to contracts between the Club and its members.
9. Ending the agreement
- The Club can stop using MOTVIVO at any time by telling us at [email protected]. A paid plan runs to the end of the period already paid; we do not refund the remainder, except where these Terms say otherwise.
- We can end these Terms with 60 days’ notice, and immediately if the Club seriously breaks them and does not fix the breach within 14 days of being told (or immediately where it cannot be fixed).
- After the end, the Club can export its data for 30 days. We then delete it, as set out in the data processing agreement, except where the law requires us to keep it.
10. Changes to these Terms
We may update these Terms, for example for new features, legal requirements or changes to the service. We tell the Club about material changes at least 30 days before they apply, by email and in the staff app, where an administrator is asked to accept the new version. If the Club does not agree, it can end the agreement before the changes apply.
11. General
- These Terms, the data processing agreement and the plan details at motvivo.com/pricing are the whole agreement for using MOTVIVO, unless the Club has a separate written agreement with LuxArte.
- We may use subcontractors (such as hosting and email providers, listed in the data processing agreement) and may transfer these Terms to a company that takes over MOTVIVO, with notice to the Club.
- Notices to the Club are sent to the email address of its account owner; notices to us go to [email protected].
- If a provision is invalid, the rest of these Terms still applies.
- These Terms are governed by the laws of the Republic of Cyprus. The courts of the Republic of Cyprus have exclusive jurisdiction, unless mandatory law provides otherwise.
